- रायपुर। सुप्रीम कोर्ट ऑफ इंडिया ने निपुण सक्सेना विरूद्ध यूनियन ऑफ इंडिया व अन्य की रिट याचिका पर निर्णय देकर 29 दिसम्बर 2018 को केन्द्रीय गृह और महिला एवं बाल विकास मंत्रालय समेत सभी राज्यों और केन्द्र शासित प्रदेशों को दुष्कर्म पीड़िता चाहे वे बच्चे हों या बालिग हों की पहचान गोपनीय रखने संबंधी आवश्यक दिशा-निर्देश जारी किया है।
महिला एवं बाल विकास विभाग की आयुक्त ने माननीय सुप्रीम कोर्ट के निर्देशों की जानकारी देते हुए बताया कि कोई भी पिं्रट मीडिया या इलेक्ट्रॉनिक या सोशल मीडिया आदि किसी भी प्रकार से ऐसा समाचार, तथ्य या जानकारी प्रकाशित ना करें जिससे पीड़िता का नाम या पहचान सार्वजनिक हो सके। ऐसी पीड़िता जो मानसिक रूप से विक्षिप्त है, या मर चुकी है,की पहचान को परिजन या सक्षम अधिकारी द्वारा गोपनीय रखा जायेगा जब तक कि सक्षम प्राधिकरण द्वारा परिस्थिति अनुसार आवश्यक ना हो, इसका निर्धारण सेशन जज द्वारा किया जाएगा।
सुप्रीम कोर्ट द्वारा जारी दिशा-निर्देशों के अनुसार भारतीय दण्ड विधान की धारा 376,376A,376B,376C 376D,376DA,376 DB या 376 E के तहत अपराध से संबंधित एफ.आई.आर.(प्रथम सूचना रिपोर्ट) और पॉक्सो( POCSO) के तहत अपराध सार्वजनिक डोमेन में नहीं डाला जाएगा। पुलिस अधिकारियों को चाहिए की वह पीड़िता का नाम जहां तक संभव हो,उन सभी दस्तावेजों को सील कवर में गोपनीय रखें जिससे उसकी पहचान सुरक्षित रखी जा सके। सभी प्राधिकरण अथवा सक्षम अधिकारी जिनके समक्ष पीड़िता के नाम का खुलासा जांच एजेंसी या अदालत द्वारा किया जाता है, वे सभी एजेंसी, अदालत, सक्षम अधिकारी भी पीड़िता के नाम और पहचान गुप्त रखने के लिए बाध्य हैं। किसी भी तरीके से पीड़िता के नाम का खुलासा नहीं किया जा सकता सिवाय जांच एजेंसी या न्यायालय को भेजे गए प्रतिवेदन के रूप में, वह भी सीलबंद लिफाफे में भेजा जाना चाहिए।
